Terms of Use

These Terms of Use ("Terms") govern your access to and use of the WallAI Wallpapers mobile application (the "App") provided by WallAI ("we", "us", or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on a device that you own or control, solely for your personal, non-commercial use.

2. Eligibility

You must be at least 13 years of age (or the applicable age of consent in your jurisdiction) to use the App. By using the App, you represent and warrant that you meet this requirement.

3. User Content and AI-Generated Wallpapers

3.1 Your Input

You are solely responsible for the text prompts, affirmations, and other content you submit to the App. You agree not to submit content that is unlawful, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable.

3.2 Generated Content

Wallpapers generated through the App are created using third-party AI models. You are granted a personal, non-exclusive license to use generated wallpapers on your personal devices. We do not guarantee that generated content will be unique, original, or free from resemblance to existing works.

3.3 Restrictions

You may not:

• Use generated wallpapers for commercial purposes without our prior written consent.
• Claim exclusive ownership or copyright over AI-generated content.
• Use the App to generate content that infringes on third-party intellectual property rights.
• Redistribute, resell, or sublicense generated wallpapers in bulk or as part of a competing service.

4. Subscriptions and Purchases

The App may offer in-app purchases or subscriptions. All payments are processed through the Apple App Store. By making a purchase, you also agree to Apple's applicable payment terms. Subscription terms, pricing, and renewal information are displayed within the App prior to purchase.

• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period.
• You can manage and cancel subscriptions through your device's App Store settings.
• Refunds are subject to Apple's refund policies.

5. Prohibited Conduct

You agree not to:

• Reverse engineer, decompile, disassemble, or attempt to derive the source code of the App.
• Use the App for any illegal, fraudulent, or unauthorized purpose.
• Interfere with or disrupt the App's servers, networks, or infrastructure.
• Attempt to bypass any security measures or access restrictions.
• Use automated tools, bots, or scrapers to access the App or its content.

6. Intellectual Property

The App, including its design, code, logos, trademarks, and all non-user-generated content, is owned by WallAI and protected by applicable intellectual property laws. Nothing in these Terms grants you any right, title, or interest in the App beyond the limited license described above.

7. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

8. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WALLAI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, REGARDLESS OF THE THEORY OF LIABILITY.

9. Indemnification

You agree to indemnify, defend, and hold harmless WallAI and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the App or violation of these Terms.

10. Termination

We may suspend or terminate your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or our business. Upon termination, your license to use the App is immediately revoked.

11. Apple App Store Terms

If you downloaded the App from the Apple App Store, the following additional terms apply:

• These Terms are between you and WallAI, not with Apple Inc. Apple has no obligation to provide maintenance or support for the App.
• In the event of any failure of the App to conform to applicable warranties, you may notify Apple for a refund of the purchase price (if any). Apple has no other warranty obligation with respect to the App.
• Apple is not responsible for addressing any claims relating to the App, including product liability, legal compliance, or intellectual property infringement.
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Republic of Turkey, without regard to its conflict of law provisions.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting updated Terms within the App or on our website. Your continued use of the App after changes are posted constitutes your acceptance of the revised Terms.
